How long will a personal injury claim take?

Every personal injury case is unique, so this will depend upon the circumstances of your individual case. Some straightforward motor vehicle collisions may settled within a matter of months, where as a case involving a serious injury is likely to take much longer. We will be in a much better position to advise on this once we have completed our initial investigation of the case.

My injury occurred some time ago, can I still a claim for compensation?

The general rule is that you have 3 years from the date of your injury within which to make a claim. If the accident involved a child, then the 3 years only starts to run from the child's 18th Birthday. There are however exceptions to this rule, and it is always better to seek legal advice as soon as possible following any accident.

I am not even sure if I have a claim for compensation and wouldn't want to waste anyone's time.

We recognise that every case is different, and so we carefully assess every case on an individual basis. If we do not believe you have a case then we will tell you, as it is our obligation. It is not in anyone's best interests to proceed with a case we do not believe will succeed.

How much compensation am I likely to receive?

Again, as every personal injury case is unique, the amount of compensation will depend upon the particular circumstances of each case and the medical evidence, and other relevant evidence obtained. Until we know the extent and duration of the injuries suffered, we are unable to say how much compensation is likely to be awarded.

How will my personal injury claim be funded?

In nearly all cases, and this is subject to our early assessment procedure, we are able to offer a conditional fee agreement (no win, no fee). This will cost you nothing. There are however other means of funding, such as the existence of legal expense insurance, and we will be able to assist you in identifying at a very early stage, if this is available to you.

Recently settled personal injury claims

  • Our client was injured when she was walking past a row of parked vehicles and the defendant reversed out of a parking space and knocked her to the floor. Our client suffered with pain and stiffness which resolved within seven weeks of the accident. Injuries to her hands and grazing to her right elbow as a result of the fall resloved four weeks post accident. She also suffered psychological symptoms and was diagnosed with an anxiety disorder - this was expected to be resolved within six months with the help of CBT treatment. The client received £5,110.

  • We recently settled a case for a claimant who had sustained an injury due to a defective multi-use machine in her gym. The machine crushed the claimants left thumb and she fainted on the spot. She suffered a laceration, bruising and swelling, all of which settled within 4-6 weeks. She expereinced moderate pain and discomfort during that period. The injury helaed satisfactorily and left only a small scar and some mild sensitivity issues in extremely cold weather. She recived £1,850 in compensation. 

  • Our client was having their tattoo removed and was told the tattoo would initially scab over and then the tattoo would be removed once the scab came off. After the treatment the client was concerned and attended the clinic where she was told it should look the way it did. Our client then visited a pharmacist who advised her to go to hospital where she was advised that she had suffered a second degree burn as the plexr machine had gone too deep into her skin. The client received £5,000.

  • Our client sustained soft tissue damage, whiplash and suffered driver anxiety as the result of being the victim of a road traffic accident. She received £3,500 in compensation.

  • Our client was eating breakfast in a cafe when he bit down on a piece of toast. There was a foreign object int he toast which caused his tooth to break. The tooth required dental work which is anticipated to last between 12-15 years before needing to be replaced. He was awarded £4,000 for compensation, reimbursement of his out of pocket expenses and to cover the cost of replacing the work every 12-15 years. 

  • Our client and her sister were waiting for a lift inside a retail premises. The claimant's sister took a step back and lost her balance after hitting a display crate with her heel. She grabbed the claimant's left arm for support causing her to fall sideways onto a bench, landing on her left side. The claimant sustained soft tissue injuries to her neck and an aggravation to a pre-existing condition. The claimant was referred for physiotherpay treatment following the accident and was awarded £1,800 in compensation. 

  • Our client attended a bingo venue when a cash box was moved and caused a 3cm laceration to her right shin. This required dressing sto be changed every four days for five weeks and the medical expert expects there will be a permanent scar. The claimant received £3537 in compensation. 

  • Our client was standing at the end of a counter ina  newsagent when without warning the floor collapsed from underneath him. He sustained injuries and was awarded £1,250.

  • Our client attended a salon with a view to having a semi-permanent lip liner tattoo. The claimant had requested a 'nude colour' and was advised that for the first four to six weeks the colour would be darker than requested but would fade to the correct colour. Immediatley after the tattoo the claimant told the defendant of her concerns regarding the colour. The tattoo failed to fade to the correct colour and the claimant was left with a permanent dark grey line on the borders of her upper and lower lips which requires laser treatment and daily camouflage treatment. The claimant suffered significant pain following the procedure and suffered moderate psychological trauma for which CBT psychotherapy was recommended. The claimant was awarded £26,500.

  • Our client attended the defendant clinic in order to have a tattoo removed on her right lower arm. A week before the procedure our client visited the defendant for an initial consultation and was advised that they would remove the tattoo via a plexr machine and not laser. On the day of the accident, our client attended the clinic and signed the relevant paperwork.  Our client was advised that the tattoo would initially scab over and once the scab came off the tattoo would be removed.  Treatment was carried out. Our client felt immediate pain, On 27 June 2016 our client contacted the clinic, sent a photograph of her arm and then attended the clinic where she was advised that it should look like the way it did. On 29 June 2016 our client saw a pharmacist who recommended for our client to go to the hospital. At hospital she was advised that she had suffered a second degree burn as the machine had gone too deep into her skin. The client received £6,000 in compensation.
