How long will a personal injury claim take?

Every personal injury case is unique, so this will depend upon the circumstances of your individual case. Some straightforward motor vehicle collisions may settled within a matter of months, where as a case involving a serious injury is likely to take much longer. We will be in a much better position to advise on this once we have completed our initial investigation of the case.

My injury occurred some time ago, can I still a claim for compensation?

The general rule is that you have 3 years from the date of your injury within which to make a claim. If the accident involved a child, then the 3 years only starts to run from the child's 18th Birthday. There are however exceptions to this rule, and it is always better to seek legal advice as soon as possible following any accident.

I am not even sure if I have a claim for compensation and wouldn't want to waste anyone's time.

We recognise that every case is different, and so we carefully assess every case on an individual basis. If we do not believe you have a case then we will tell you, as it is our obligation. It is not in anyone's best interests to proceed with a case we do not believe will succeed.

How much compensation am I likely to receive?

Again, as every personal injury case is unique, the amount of compensation will depend upon the particular circumstances of each case and the medical evidence, and other relevant evidence obtained. Until we know the extent and duration of the injuries suffered, we are unable to say how much compensation is likely to be awarded.

How will my personal injury claim be funded?

In nearly all cases, and this is subject to our early assessment procedure, we are able to offer a conditional fee agreement (no win, no fee). This will cost you nothing. There are however other means of funding, such as the existence of legal expense insurance, and we will be able to assist you in identifying at a very early stage, if this is available to you.

Recently settled personal injury claims

  • Our client attended the defendant clinic in order to have a tattoo removed on her right lower arm. A week before the procedure our client visited the defendant for an initial consultation and was advised that they would remove the tattoo via a plexr machine and not laser. On the day of the accident, our client attended the clinic and signed the relevant paperwork.  Our client was advised that the tattoo would initially scab over and once the scab came off the tattoo would be removed.  Treatment was carried out. Our client felt immediate pain, On 27 June 2016 our client contacted the clinic, sent a photograph of her arm and then attended the clinic where she was advised that it should look like the way it did. On 29 June 2016 our client saw a pharmacist who recommended for our client to go to the hospital. At hospital she was advised that she had suffered a second degree burn as the machine had gone too deep into her skin. The client received £6,000 in compensation.

  • Our client was shopping when a sign on the top shelf fell and hit her on her forehead. She suffered a head injury and soft tissue injuries to her neck and spine. Our client received £3,433.

  • Our client was sat stationary at some traffic lights. When they turned green a third party drove into the back of them, shunting the client's car forward. Our client sustained whiplash to the neck and shoulders and headaches. She achieved £2,000 in damages. 

  • Our client was using a manual saw and hit a knot in the wood. As a result the blade jumped and the client cut through their tendon to the left thumb and had to undergo surgery. The client received £2,539.

  • Our client visited a supermarket, purchased some items and made her way to the exit. She suddenly slipped on wet bread which caused her to fall to the floor, onto her left side. She sustained a mild concussion type injury which only lasted minutes following the fall, bruising to her left hip, a sprain to her left wrist and shock & stress which lasted for 2-3 days. The client received £3,000 in compensation. 

  • Our client bought a oil lamp which requires liquid oil to be poured in and then lit to create a flame effect. The client got a backdraft from the oil lamp and sustained second degree burns to the right arm, right side of face and right ear. Our client was medically examined and received £3,750 in compensation.

  • We recently represented a man who sustained personal injury in late 2014 when he was ejected from his wheelchair and hit his head on the pavement as a result of the front right caster of his wheelchair becoming detached. The NHS Trust were responsible for servicing and maintaining the wheelchair and had recently modified the wheelchair, prior to the man’s accident. As a result of the accident, the man sustained a laceration which left a permanent three cm scar on his forehead. Liability was denied by the Trust, however, they subsequently accepted an offer of settlement, which was later approved by the court, noting that the man was regarded as a protected party, on the basis that he did not have capacity to conduct litigation due to the effects of long standing multiple sclerosis, which affected his speech and his ability to communicate verbally with others.

  • We recently settled a case for £2,400 after a man was involved in a road traffic accident and was left with pain in his neck, shoulder and lower back. He had been correctly proceeding along the road when the his vehicle was hit by another vehicle emerging from a driveway.

  • A case was recently settled for £3,187 plus costs after our client sustained a large laceration to her right shin leaving an open wound which has required dressing twice a week.

  • The claimant was assaulted by a service user at a respite unit. The service user had a history of violence which the respite unit was aware of. The claimant sustained concussion as well as multiple soft tissue injuries to her face, arms and chest. The claimant was medically examined and received £3,500 in damages.
