How long will a personal injury claim take?

Every personal injury case is unique, so this will depend upon the circumstances of your individual case. Some straightforward motor vehicle collisions may settled within a matter of months, where as a case involving a serious injury is likely to take much longer. We will be in a much better position to advise on this once we have completed our initial investigation of the case.

My injury occurred some time ago, can I still a claim for compensation?

The general rule is that you have 3 years from the date of your injury within which to make a claim. If the accident involved a child, then the 3 years only starts to run from the child's 18th Birthday. There are however exceptions to this rule, and it is always better to seek legal advice as soon as possible following any accident.

I am not even sure if I have a claim for compensation and wouldn't want to waste anyone's time.

We recognise that every case is different, and so we carefully assess every case on an individual basis. If we do not believe you have a case then we will tell you, as it is our obligation. It is not in anyone's best interests to proceed with a case we do not believe will succeed.

How much compensation am I likely to receive?

Again, as every personal injury case is unique, the amount of compensation will depend upon the particular circumstances of each case and the medical evidence, and other relevant evidence obtained. Until we know the extent and duration of the injuries suffered, we are unable to say how much compensation is likely to be awarded.

How will my personal injury claim be funded?

In nearly all cases, and this is subject to our early assessment procedure, we are able to offer a conditional fee agreement (no win, no fee). There are however other means of funding, such as the existence of legal expense insurance, and we will be able to assist you in identifying at a very early stage, if this is available to you.

Recently settled personal injury compensation claims

  • Our client, a delivery driver, injured himself at work after sustaining a back injury when he had to climb up the side of a truck to load it despite requesting a step numerous times. As he climbed up to the back of the truck he slipped and twisted his back. This resulted in a soft tissue injury and he required assistance with domestic tasks for two days following the accident. He was required to take these two days off from work as holiday and as he is an agency worker he lost these. Our client was awarded £3,522 in compensation. 

  • Our client slipped on some water on the floor whilst shopping in a wholesale warehouse. As she slipped she caught her right leg on the underside of her trolley resulting in a laceration. There were no wet floor signs present and the defendant admitted liability. The laceration developed into a venous leg ulcer which took 26 months to heal. She was left with scarring and advised not to expose her leg to sun which impacted her enjoyment of holidays she already had booked prior to the accident. Her ability to carry out tasks at work was also impacted and the medical expert claimed that the ulcer had disadvantaged her in her career as a publican. The claim settled for £10,429. 

  • Our client suffered a closed fracture in her toe after a glass table top fell onto her foot. The table top had slid from between two chair cushions as she unwrapped some garden furniture from the packaging. The manufacturers and distributors of the product admitted liability and she received £4,613 in compensation. 

  • Our client slipped when walking from a carpeted area to a wooden walkway in a bar. She landed on her back and sustained a soft tissue injury to her right ankle. She was medically examined and it was expected that she would fully recover from her injuries within 18 months and was referred for physiotherapy to alleviate her symptoms. She received £4,273 in compensation.

  • Our client suffered an accident at work when he was working as a labourer on a building site. He was asked to work on scaffolding, at height, without adequate training or assistance from colleagues. Our client lost his footing whilst carrying heavy materials up a ladder, causing him to fall from height and suffer serious injuries to his heels and ankles. He was awarded £225,000 in compensation.

  • Our client suffered an injury at work whilst working as a sales assistant in a clothing store. She slipped on a wet floor and hit her head and elbow on the wall before landing on her back on the floor. She sustained injury to her neck, left shoulder and left hip. Our client received £2,300 in compensation. 

  • Our client sustained injury to her left shoulder whilst at work at a crematorium. She was working as a secretary to a funeral director and was visiting the crematorium to prepare for a funeral when she slipped on a patch of algae on a pathway. She landed on her knee and fell into a nearby wall with her left shoulder. She received £9,601 in compensation. 

  • Our client was knocked from his bicycle by a dog when it jumped up at him when he passed it. This caused the client to be thrown over the handle bars of his bike and he sustained cuts, facial and dental injuries and soft injuries to his shoulder. He received £9,039 in compensation.  

  • Our client was injured in a public place. She was exiting a fast food restaurant and walked into a ceiling to floor clear glass window panel which the defendant had failed to mark with a warning sign. She suffered bruising to her face and oral damage which resolved two weeks post-accident. She also suffered severe nasal pain which she was expected to recover from within a year. She was awarded £1,550 in compensation. 

  • Our client was shopping in a supermarket when she was injured. She was hit by a six foot cage being pulled by an employee. The cage hit the back of her leg causing a 15cm laceration. As a result our client has been left with a 15cm by 5mm permanent scar and she has lost confidence walking freely around. The experience still upsets the client and she will no longer wear skirts because she feels the scar is unsightly. Liability was admitted and the client received £10,000.
