How long do you have to make a personal injuries claim?

The general rule is that you have 3 years from the date of your injury within which to make a claim. If the accident involved a child, then the 3 years only starts to run from the child's 18th Birthday. If you are unaware of the injury or illness for a prolonged amount of time or find out at a later date that it was in fact due to negligence, and therefore not your fault, then this 3 year rule can be extended.

There are other exceptions to this rule, and it is always better to seek legal advice as soon as possible following any accident.

How long does a personal injury claim take?

Every personal injury case is unique, so this will depend upon the circumstances of your individual case. Some straightforward motor vehicle collisions may settled within a matter of months, where as a case involving a serious injury is likely to take much longer. How do I know if I can make a personal injury claim?

How much compensation am I likely to receive?

How is my personal injury claim calculated?

There are two factors that are used to calculate claims as a result of personal injury cases, these are general damages and special damages. General damages are the immediate effects that the injury has upon you, such as pain or suffering on your part, whereas special damages are the costs of any medical procedures and inability to work etc.

These two factors are then used to work out how much you are owed, but can still vary depending on the specific aspects of your case and how much it has affected you.
