Am I more likely to have an accident abroad?

Unfortunately, accidents are often not preventable as we just don’t see them coming. Traffic accidents in countries overseas may be the result of unusual local traffic systems, different standards of care on the part of local drivers and being unfamiliar with customs that are not part of the official local traffic rules. Many of us now choose to take our cars abroad with us, whether we are planning a driving holiday or just prefer the convenience of being able to travel independently. Car and bike rental is also extremely popular with many people who want to explore the areas they are visiting. With more people on the roads and more people driving abroad unfortunately accidents do sometimes happen.

Don’t you have to claim locally for an RTA abroad?

No, it’s not the case that a claim for compensation for a traffic accident abroad has to be made in the country where the accident occurred. It is possible to make a claim via the English courts for a foreign accident and this is something that our road traffic accident team can help you with.

What is the law and how does this work?

For accidents that took place in Europe there are European directives - specifically the EU 4th and 5th Motor Insurance Directives - that are designed to ensure a UK handling agent is appointed by a European insurer. This handling agent deals with the claims in English and is able to structure a timetable for the claim so you know what is happening and when. Thanks to the EU directives there are fewer issues with language based obstacles or cultural differences and this can make settling a claim much more straightforward.
