Accidents that occur where air travel is concerned are fairly tricky, as they tend to take place across a range of international jurisdictions. This can mean that establishing which laws apply requires considerable experience - claims for airline accidents are normally governed by a selection of international conventions.

The Montreal Convention on International Carriage By Air is the most important of these for someone who has been a plane passenger and is seeking damages for an accident that has occurred. The Montreal Convention mostly replaces the earlier Warsaw Convention, which you may also have heard mentioned, although some of Warsaw does still apply.

Where either the Montreal Convention on International Carriage By Air or the Warsaw Convention applies to your claim, they will cover accidents that take place on board an aircraft. They can also apply to any incident that takes place during embarkation or disembarkation from the aircraft. The range of incidents that could be covered by an airline accident claim could be anything from falling at some point during your time on the aircraft to being involved in an airline crash, of whatever severity.

Why are airline/aviation claims different?

There are a number of ways in which an aviation claim differs from a regular claim for an accident or injury. The Montreal Convention, for example, has something called a ‘quasi-strict liability’ approach, which means that it’s not necessary for you to prove that there has been any negligence or fault with respect to the actions of the airline. Instead, all that must be proven is that the accident falls in the definition of an air accident.

Other differences include the time limits involved, which are different to those with respect to a normal claim. There are also certain types of damages that you can’t claim in this situation, as well as some where the amount that is claimable is capped. Rules on which countries’ courts are able to handle aviation accident claims also complicate the issue.
