Do I need the original deeds to sell my property?
Most homes in England and Wales are now registered with HM Land Registry (HMLR). If your property is registered, you do not need old paper deeds; a copy of the title register from HMLR is usually sufficient. However, some older properties (particularly those outside London and untouched since the 1980s or earlier) may still be unregistered. Unregistered properties normally require the original deeds to sell.
Can I register a property without deeds?
Yes. If the deeds have been lost, stolen, or destroyed, you can apply to HMLR for first registration without them. This is usually required before any sale can proceed.
What you need to do
1. Try to find the deeds
HMLR will expect proof that you have made reasonable attempts to locate them. This may include:
- Searching the property
- Asking relatives
- Checking with your mortgage lender
- Contacting local solicitors who may have acted in the past
You should also gather any documents that show your ownership or occupation. This can include evidence of payment of utilities, ground rent, or service charge. You should keep a clear record of what checks you have carried out, when you did them, and the outcome.
2. Statement of truth
This document explains:
- Why the deeds are missing
- Why you are entitled to register the property
- What steps you have taken to find the deeds
- How long you have owned or occupied the property
3. Undertaking
You must provide a written promise confirming that if the deeds are ever found, you will send them to HMLR.
4. Sending the application to Land Registry
Your application will include:
- Completed forms
- HMLR fee
- Identification documents
- Supporting evidence
- Statement of truth
- Undertaking
What happens next?
HMLR will review your application and may register the property, request more information, or reject the application. If successful, the property is usually registered with Possessory Title.
