What is amputation caused by unsafe manual handling or crushing injuries?

Amputation refers to the loss or removal of a limb or body part, either fully or partially. When caused by unsafe manual handling or crushing incidents, these injuries typically result from heavy machinery, falling objects, poor safety procedures or a failure to provide proper training and equipment. Examples include fingers being caught in moving parts, feet being run over by industrial vehicles or limbs crushed under fallen loads. In some circumstances, emergency surgical amputation is required to save a person’s life following such incidents.

These types of injuries not only cause physical and emotional distress but can also impact your ability to work, perform daily activities and enjoy your previous quality of life. Victims may require lifelong care, prosthetics, ongoing rehabilitation and psychological support.

Can you claim compensation for amputation due to unsafe manual handling or crushing injuries?

Yes, if your amputation injury was caused by unsafe working conditions or negligence on the part of an employer or another responsible party, you may be entitled to compensation. Employers have a legal duty to ensure a safe working environment under the Health and Safety at Work etc. Act 1974, which includes providing adequate manual handling training, maintenance of machinery, and appropriate protective equipment. If they have failed in this duty and it has resulted in your injury, a personal injury claim may be brought against them.

Compensation can cover a range of losses including pain and suffering, loss of earnings (past and future), medical and rehabilitation costs, travel expenses and adaptations to your home or vehicle.

Frequently asked questions

How long do I have to make a claim?

In most cases, you have three years from the date of the injury to make a personal injury claim. However, there are exceptions, for example in cases involving children or those lacking mental capacity. We recommend seeking legal advice as soon as possible to avoid missing important deadlines.

What if I was partially at fault?

You may still be able to claim if you were partly responsible for the accident. In such cases, your compensation may be reduced to reflect your share of the blame, but legal advice can help establish a fair assessment of liability.

Will I need to go to court?

Most personal injury claims are settled out of court. We will always aim to negotiate the best possible settlement for you without the need for a trial. If court proceedings become necessary, we will guide and support you through every stage.

Can I claim on behalf of someone else?

Yes, if a loved one is unable to make a claim themselves – for example, if they are a child or lack the mental capacity – you may be able to claim on their behalf as a litigation friend. Our team can advise you on the appropriate steps to take.
