What is an amputation caused by a defective consumer product?

An amputation caused by a defective consumer product refers to the loss of a limb or part of a limb due to a malfunction, flaw or lack of adequate safety features in an item that has been purchased for personal use. These injuries can occur from household appliances, power tools, machinery, children’s toys, garden equipment, or even medical devices. Common causes include sharp edges, lack of safety guards, overheating components or mechanical malfunctions.

In these cases, the manufacturer, distributor or retailer of the faulty product may be held responsible for the injury. Under the Consumer Protection Act 1987 and general product liability law, consumers are entitled to expect that the products they purchase are safe when used as intended.

Can you claim compensation for an amputation caused by a defective product?

Yes, if you have suffered an amputation due to a defective consumer product, you may be eligible to claim compensation. To do so, you must prove that:

  • The product was defective or unsafe
  • The defect directly caused or significantly contributed to your injury
  • You were using the product in a reasonably foreseeable way

Compensation can cover a range of losses, including pain and suffering, medical and rehabilitation costs, prosthetics, home adaptations, loss of earnings, and the ongoing costs of care and support. In fatal accident cases, family members may also claim for bereavement damages and financial dependency.

Frequently asked questions

How long do I have to make a claim?

In most cases, you have three years from the date of the injury or the date you became aware of the defective product's involvement to make a personal injury claim. However, there are exceptions, especially in cases involving children or individuals lacking mental capacity. It is advisable to seek legal advice as soon as possible.

How much compensation could I receive?

The amount of compensation depends on the severity of the injury, the level of disability, and the financial impact on your life. Factors such as loss of earnings, medical expenses, prosthetic costs and the need for future care will be considered when calculating any award.

What if the product was made outside the UK?

You may still be able to make a claim. Manufacturers, importers or distributors operating within the UK have a duty to ensure that the products they supply meet safety standards. We can help determine liability and advise on the appropriate course of action.

Do I need to keep the product?

Yes, if it is safe to do so, keep the defective product in its current state and avoid attempting any repairs. It may serve as crucial evidence in supporting your claim. Photographs, receipts, packaging and instructions can also be useful.

Will I have to go to court?

Not necessarily. Many personal injury claims are settled out of court through negotiation. However, if a fair settlement cannot be reached, we will represent you and your interests robustly in court proceedings.
