Do not dispute - mend fences

When it comes to renewing or replacing fences on your property, you need to be alive to the fact that neighbour disputes can (and very often do) occur over such a plan. 

Of course, the best way to resolve a dispute is to simply engage with your neighbour beforehand and agreeing a course of action before you carry out work. 

 The first thought on your mind should always be: do I know where my boundary ends and my neighbour’s boundary begins? 

When involved in a dispute regarding a boundary between your property and your neighbour, the first port of call is to seek legal advice. It might be that the history of your property can be drilled into to determine some important considerations like: 

  • Should expert evidence be obtained to give an opinion as the boundary? 
  • Did you and your neighbour (or even people who owned your property or your neighbour’s property) come to an agreement in the past as to the boundary which could bind your neighbour? 
  • Have you gone beyond your boundary and taken a part of your neighbour’s land that you could now seek possession of? 
  • Do the features in place at the moment or that might have existed in the past give any assistance when interpreting plans?
