Most of us have come to expect that our image or our voices will be recorded when we go about our daily lives. However, what we do not expect is that these things will be captured in the privacy of our homes/gardens. 

As the prevalence of CCTV systems rise, and technological advancements are made, our right to privacy is of course a big concern. Some CCTV systems on the market can be incredibly sophisticated – from quality of image or range of audio.

Where does that leave your concerns?

Case law suggests that you can pursue a neighbour through the County Courts for claims including breach of data protection laws and harassment as a result of CCTV systems.

In pursuing a claim, consideration will need to be given to the type of devices installed, the measures taken by neighbours to warn of CCTV footage, and whether your neighbour has CCTV systems installed for specific purposes (such as crime prevention/detection).

If you are concerned that your neighbours CCTV system is invading your privacy, it is important to seek specialist legal advice as to any potential claims you may have, and of course the steps that need to be taken beforehand.

Similarly, if you have installed CCTV systems on your property, you should take legal advice as to your obligations under data protection laws to prevent and/or minimise the risk of claims being made against you.
