Representations against barring

The Disclosure and Barring Service came into being in December 2012 and took over the previous roles of the Criminal Records Bureau and Independent Safeguarding Authority.

A number of professions and roles require reference to the safeguarding provisions if individuals are likely to come into contact with vulnerable adults or children.

Organisations and employers are under a duty to refer cases to the Disclosure and Barring Service if individuals are subject to disciplinary proceedings or dismissed from an office or position.

The Disclosure and Barring Service will then investigate the case and determine whether the individual should be added to the barred list to prevent them from working or having involvement in activities which may bring them into contact with vulnerable adults or children.

The effect of a barring can prevent employment, or activities which may include scouting, after school clubs, football clubs, rugby clubs or parent teacher associations.

In some cases barring is automatic (following a conviction or caution) but in other cases, the Criminal Records Bureau will make investigations and determine whether they intend to make a Barring Order following a referral to them.

At this stage, you have the right to make representations to argue that barring should not occur.
