Our commercial property team and conveyancing teams are appointed to various panels, including being appointed to the West Yorkshire framework agreement for general property comprising of all acquisitions, disposals, licences, landlord/tenant and right to buy under the Housing Act 1985, conveyancing and related litigation.

We provide our clients with as much direct access to communicate with our teams as possible, through direct dials, emails and holding regular meetings and training. To give our clients assurance over the consistency of our communications we operate to Service Level Agreements that have set response times.

Financing (including grants)

Stephensons has experience of many aspects of funding having acted for both borrowers and lenders. We have represented high street banks and lenders, providing funding for residential and commercial development, whether this is for a singular property, a portfolio of distinct and separate properties or full estate development. We have assisted numerous developers including residential, commercial and housing association borrowers.  

Additionally, we have sector specific expertise to assist housing associations, registered social landlords, quasi government bodies, educational establishments and local authorities in their fund raising for development projects. We understand the regulatory compliance required and always ensure our client’s need is met in this regard. The project facilities we put in place typically range from as little as £80,000 to many millions, we understand the importance of working to time scales to put this funding in place.

We have experience of all elements of security being taken for both grant funding and debt funding, including our being involved in typical charges, parent company guarantees, cross company guarantees, personal guarantees, debentures and deeds of priority.

Conveyancing, acquisitions and disposals

We work on all aspects of conveyancing from the simple to the complex. Whether buying a single residential property, a portfolio of residential properties to let, or entering into the conditional contracts for the acquisition or disposal of land for development/investment purposes. We have extensive experience of being involved in the satisfaction of conditions, planning agreements, funding arrangements, pre-let agreements, ultimate completion, construction documentation (appointments, build contracts, warranties), estate planning and then in some cases investment disposal.

In addition to typical conveyancing acquisitions and disposals we have also been involved in other transactions such as the granting and taking of easements including rights of way, the release of restrictive covenants, the variation of covenants, pre-emption agreements, options, overage agreement and other non-standard conveyancing transactions.

We have expertise in all aspects of consents and licences, including licences to occupy, licences to assign and underlet, licences for alterations etc. In this respect we have acted for both landlords and tenants, individuals and organisations. 

We have been involved in the drafting of partnership agreements and management agreements between housing associations and local authorities for housing community schemes.

Right to buy

We have for in excess of 20 years acted on right to buy transaction in relation to local authorities and other organisation. A great deal of this work involves dealing with individual house transaction, the bulk of which, being disposal, on staircasing/shared ownership schemes, or under the right to buy legislation.

Landlord and tenant

We act for landlords, tenants and investors on a whole spectrum of landlord and tenant Issues including: leases for sale and rack rent leases. We advise on portfolios in terms of individual properties and as a whole. Specialisms include: acquisitions and disposals, sale and leaseback, consent for property alterations, rent arrears, negotiating new leases, lease renewals and terminations, property management, rent reviews, licences for alterations, assignments, sub-lettings and change use, dilapidation, break clauses, insolvency, enforcement of lease terms.
