Chloe is a solicitor in the Regulatory department at Stephensons specialising in Houses of Multiple Occupation, health and social care regulation, and professional discipline.
Houses of multiple occupancy
Chloe advises and assists landlords, managers, and letting agents in relation to houses of multiple occupancy (HMO) issues. In particular, she provides advice and representation in relation to licensing applications (including refusals and revocations), enforcement action, rent repayment orders, and appeals to the first tier tribunal. Chloe has experience in dealing with a number of different local authorities across England.
Chloe assists landlords from the very early stages of an investigation to prosecution. Chloe represents landlords at interviews under caution (known as PACE interviews), including advising them on the best approach to take at the interview. Chloe assists in drafting representations in relation to notices of intent, and assists in appeals to the first-tier tribunal. Chloe also assists landlords in criminal prosecutions before the Magistrates Court, and rent repayment orders before the first-tier tribunal.
Chloe represents and advises a wide range of professionals across a number of sectors before their professional regulators. Chloe has assisted professionals with cases before the General Medical Council, General Dental Council, Nursing and Midwifery Council, Health and Care Professions Council, and the Teaching Regulation Agency. Chloe also has experience in assisting professionals facing disciplinary proceedings under the NHS Maintaining High Professional Standards Procedure.
Chloe assists professionals facing fitness to practise proceedings, from the initial referral and investigation stages, interim order hearings, through to final fitness to practise panel hearings and sanction review hearings.
Ofsted and CQC regulation
Chloe assists and represents registered providers and managers facing enforcement action by the Care Quality Commission (CQC) and Office for Standards in Education, Children’s Services and Skills (Ofsted). Chloe provides advice on compliance, challenging inspections, enforcement action, and appeals to the first-tier tribunal (Care Standards Chamber).
In particular, Chloe assists providers and managers in relation to the following:
- Drafting representations in relation to inspection reports and ratings
- Challenging warning notices and notices to cancel, suspend or impose conditions on registration
- Challenging notices to refuse registration; and
- Appeals to the first-tier tribunal.
Chloe has acted as a judge at the Great British Care Awards and is a member of the Association of Regulatory and Disciplinary Lawyers (ARDL).
Motoring offences and road transport
Chloe also assists and advises clients in relation to a range of motoring offences, including drink driving, drug driving and failing to provide a specimen, and has experience of advising and representing drivers at public inquiries before the traffic commissioner.
