Historical child abuse

When it comes to cases of historical abuse, the details can be extremely complex for those who have suffered and have to recall what happened. Historical physical and/or sexual abuse can range from anytime between childhood and to just a matter of a few years ago, and the victim may question whether seeking legal advice is worthwhile if they fear there may be a lack of evidence. However, regardless of when the physical or sexual abuse happened, seeking legal advice is highly important.

Although money will never erase what happened, it can help victims to move forward with their lives and can give them the financial security they deserve.

Reporting historical abuse to police

The idea of reporting historical abuse to the police, whether physical or sexual, can be an extremely daunting prospect; but, it can be vital in getting the justice you deserve. A few things to remember when considering whether to report historic abuse include:

  • The police are there to help you
  • The police will have experience in dealing with cases similar to yours, and understand how difficult it is – they will be able to empathise and be patient throughout the whole process
  • Your story may be the missing piece to a much larger picture that you didn’t even realise; whether your abuser is someone you know, knew, or a complete stranger
  • When one person comes forward to report an incident of physical or sexual abuse, it can encourage more people to follow suit and report similar things that have happened to them
  • Reporting what happened to you can feel like a weight lifted off your shoulders, and can encourage the healing process

Historical abuse cases

Historical abuse can refer to both sexual abuse and physical abuse. If the abuse you wish to make a compensation claim for is of a sexual nature and was committed prior to 1st May 2004, the crime will be dealt with under the Sexual Offences Act 1956. If the abuse you suffered happened after 1st May 2004, the crime will be charged under the Sexual Offences Act 2003.
