Dispute resolution solicitor, Heather Roberts, has recently settled a case for a client caught in a property transfer dispute with her son.
The client initially sought legal advice after she had become aware that her son was trying to sell the house she owned and lived in with the son and his family. Following multiple threats from the son, the client agreed to transfer the property into his name. However the client speaks little English and did not have the documents translated to her.
The client later obtained an injunction to prevent the sale of the property and proceeds were issued to seek declaration that the property transfer was invalid. After multiple failed opportunities for the son to file a proper defence, the client’s was granted judgment in her favour, and the property was transferred back into her name.
