Pauline Smith, associate and personal injury claims handler recently settled a case for a claimant who had sustained injury due to slipping on the edge of a concrete trench at work which was covered in algae.
The claimant, an engineer, was working on site at Ridgeway Grain attempting to reach an outside conveyor belt which needed repairing when he suddenly slipped. The claimant fell to his right side and continued to fall approximately five foot down a trench.
The claimant suffered an impacted fracture of the right fibula, neck and a spiral fracture of the right mid to distal tibia, passing down into the ankle joint at the posterior malleolus, leading to a small undisplaced fracture if the prosterior malleolus. The claimant was provided with a non-weight bearing cast for eight weeks and a partial weight-bearing cast for another six weeks thereafter and used crutches to assist with his mobility. The claimant underwent physiotherapy for his right leg. The expert opinion is that the claimant has been left with shortness of his right leg, mild pain and stiffness which if continuing beyond 18 months could be expected to be permanent.
After Stephensons proceeded with the case against the property owners, the case was settled and the claimant received £13,167.96 compensation.
