Accidents involving children

Frequently asked questions

Can I claim compensation for an injury to a child.
Yes. Even if you or the child were partly to blame for the accident, you may still be able to claim compensation.

What if I'm not sure if I can claim?
Don't worry, many people are unsure about claims generally, and particularly when it involves a child. We will assess every unique case on an individual basis, and advise you if we believe the case is likely to succeed.

How much compensation would my child get?
The amount of compensation awarded would depend on the nature and severity of your child's injuries, and these can only be properly assessed once we have obtained medical evidence.

Who will decide if the amount of compensation awarded to my child is adequate?
If your child is classed as a minor, and that is a person under the age of 18, at the time of the settlement of their claim, then it is down to the Court to approve any amount of compensation and who will confirm the award is satisfactory taking into account your child's injuries and needs.

Will I be responsible for looking after my child's compensation?
No, as a minor, that is a child under the age of 18, the Court will direct that any compensation should be invested on the child's behalf until they reach the age of 18. The Court can order the payment out of sums money, but this has to be for specific purposes, usually educational.
