Will not executed correctly

In order for a Will to be valid, it must comply with certain strict formalities. It must be in writing and signed by the deceased. If you feel that a Will has not been executed properly please contact our specialist solicitors on 0845 144 1441 for advice or complete our online enquiry form.

For a Will to be valid the deceased’s signature must have been witnessed by at least two witnesses, in the presence of the deceased, and those witnesses then have to sign the Will in the deceased’s presence. If you need to obtain a copy of the Will, you should apply for a standing search.

Stephensons have a specialist contesting wills and probate team who can look at a Will if you think that it may not be valid, and advise you. You may also be entitled to Legal Aid, depending on whether you are financially eligible.
