These types of claims include mortgage fraud, quite often committed by co-owners, partners or spouses, where that person has taken out a secured loan or mortgage on the jointly owned property, by forging the someone’s signature on it.  If you can prove that you did not benefit from the money that was released from the loan, for example by it paying off joint debts, or carrying out improvements to the property, and if you can prove that your signature was forged, you maybe able to argue that you should not be liable for the debt, and that it should not attach to your share of the property.

Identity fraud

We have also acted for many clients who have been victims of identity fraud, where the fraud is usually committed by someone not known to the client. This can range from a variety of loans, mortgages, credits cards, store cards, and we have a lot of experience in acting for such clients, and getting these debts written off.

Quite often a side effect of finance fraud is the effect that it can have on your credit rating and ability to obtain credit. Even if the finance company agrees to write off the debt, often it can be difficult to get them to remove any adverse credit references that they have put on your record. We would generally advise that if they refuse to do this, you should make a complaint to the Financial Ombudsman Service.  This is a free service, and details of how to make a complaint can be found on their website www.financial-ombudsman.org.uk.

If your claim is for less than £10,000, then it will be a small claim. Whilst this is still something we can advise you on, you are not generally entitled to recover your legal costs in a small claim, even if you win your case.  We do offer a variety of fixed fee services for the initial stages of a small claims dispute, to help you manage the costs.
