Accidents abroad - expert knowledge and experience

It takes a specific type of legal expertise to be able to make a successful workplace accident claim overseas, as the matter will be subject to a wide range of different legal systems. Those that are appropriate will depend on the relevant regulations and laws that are applicable to the liability of whoever is responsible for the accident that took place, whether that was your employer or someone else.

If you’re going to make a claim for a workplace accident abroad then it’s important to work with a team that has the expertise to identify which laws - local, national or international - the case should be governed by. It’s also key that whoever you work with understands the context to an overseas legal system and how your case will proceed through it.

Working accidents abroad - is there any protection?

Many people who are working overseas make the assumption that if anything happens to them while they are employed then it will the employer who covers them. Unfortunately, it’s not always the case that an accident will be covered by an employer’s insurance. People working overseas also often assume that if it’s necessary to look for damages for any injury that has occurred, an employer would by the natural target for that but, again, that is not always possible.

There are many ways in which employees who are going to embark on a claim need to understand not just local law but also the rules of private international law, which can be incredibly complex and which are not always weighed in favour of the individual. For example, an employee making a claim against an employer may find that the employer simply denies responsibility – that’s why it’s so key that anyone looking to make a claim takes proper advice.

Advice from Stephensons can help you handle a claim for a workplace accident overseas, ensure it is carried out smoothly and give you the best possible chance of being successful. Whether you were injured on board a ship, either in port or at sea or you were working offshore, we can offer professional, timely support. Call us on 0203 816 0065 for some free initial advice.
