How does the collaborative process work?

You and your solicitors agree to resolve all the issues – including the sharing of the assets, and the responsibilities and arrangements for children - without going to court. Everything is sorted out together, in the same room with the two solicitors advising both of you openly and the team working together. You are in control of the process, but the solicitors are there throughout, for legal guidance and assistance. 

 

Is collaborative law right for me?

Collaborative law needs the right people with the right frame of mind. It is a dignified and respectful process with the emphasis on the welfare of any children. There needs to be a willingness to disclose honestly all financial information and to be open to new ideas and compromise. If you want to set your own agenda and value retaining control over decisions, the process could be right for you.

 

What happens if the collaborative process breaks down?

The collaborative process takes away the threat of expensive and stressful court proceedings and allows the team to work together and your solicitors to advise together openly to try and resolve issues. Consequently, these solicitors cannot represent either of you if the process breaks down and you have to go to court. What if my ex partner will not give me their financial information?

 

At the outset, you will agree to sign a binding agreement that includes a promise to provide full and frank financial disclosure and documents and this disclosure can be in the same form as the court process. Failure or refusal to provide relevant information is a breach of the agreement and the process will fail.

 

What is collaborative law?

 

Collaborative law is an alternative to court proceedings. It allows separating or divorcing couples to work with their solicitors as a team to resolve disputes in a better way, without going to court.
