Commercial tenant fixed fee packages

 

Our bronze package service comprises of:
 
  1. Preparing a report on the initial lease received, but excludes all negotiation, making amendments or considering any further forms of lease.
  2. Dealing with completion formalities, including registration at the Land Registry if appropriate.  

Due to the limited nature of this package, we will not be liable for any losses, suffered as a result of our restricted instructions.

Please note, for example, though this is not an exhaustive list, that many appropriate service provisions are not included in this package, such as raising of enquiries of Landlord, carrying out typical due diligence i.e. searches and enquiries of local authorities, mining and water boards etc, amending and negotiating the lease, considering ancillary lease documents, considering and reporting on title issues affecting the Landlord’s  superior  property interests, seeking consents of superior landlords or mortgagees. 

Given that this is a fixed price package, we will limit the time spent on the matter (whether that be in preparation and perusal, telephone conversation, written exercises including emails, or otherwise). For a transaction and product of this nature, we estimate 3-4 hours work being required. We will however carry out within this package work up to 5 hours total. Should we envisage the need to spend more than 5 hours work to achieve the objectives of the bronze package, we will immediately contact you to explain and discuss additional work and associated fees required.

 

If the lease is to be excluded from the security of tenure provisions of the Landlord and Tenant Act 1954 in addition to the draft lease we shall also need to prepare notices and statutory declarations for serving on the tenant. Our additional costs in preparing this documentation will be £75 plus VAT but where there is also a guarantor to the lease our additional costs will be £100 plus VAT.   2. Raising standard enquiries of the landlord and reporting upon the same. 
  3. Dealing with completion formalities, including registration at the Land Registry if appropriate.

  3. Considering and reporting on title issues affecting the Landlord's superior property interests.
  4. Raising and reporting on typical due diligence searches (local, mining, water and drainage, chancel and desktop environmental)
  5. Dealing with completion formalities, including registration at the Land Registry if appropriate.

 

Due to the limited nature of this package, we will not be liable for any losses, suffered as a result of our restricted instructions.

The platinum package is a bespoke service; the full extent of the work that we are to carry out will be agreed with you. We anticipate that it will be the gold package but without limitation on the amount of negotiation, amendments, investigation, reporting etc. It will be a fee based on an hourly rate agreed with you, with a cap on the number of hours that you wish for us to perform in our duties.

The basic fee packages are prepared for advising on standard lease arrangements, and though within the packages there are details of what services are included and excluded, in all cases the packages exclude advising on, such as:

 

  • New build arrangements, construction documents, warranties, and matters alike.
  • Multiple property titles,
  • Unregistered titles,
  • Extra negotiations and advices beyond what is included within the packages,
  • Title defects that require advice, insurance or other,
  • Agreement for leases, licences for alterations, licences to underlet and, consents and alike.

 

This list is not exhaustive but covers many eventualities.

 

We will as soon as we become aware of something that is not included  within your chosen package,  whether that is at the outset or during the transaction, make this immediately known  to you, so you can decide whether you wish to instruct us to cease acting, or proceed with or without assistance  upon those matters or otherwise. We will at such time provide you with an additional fee estimate for any extra work required.
