Areas of specialism
- Advice on benefit entitlements
- Challenging benefit decisions
- Advise other departments on benefit related issues
Ngaryan often acts as an expert witness in benefit fraud prosecutions. She is instructed regularly by several firms which specialise in criminal law. She examines both the accuracy and the recoverability of the alleged benefit overpayment. This often includes calculating any underlying entitlement during the period of the alleged offences which may be relevant for both sentencing purposes and whether or not an offence has been committed.
Cases of note
Ngaryan was able to secure housing benefit entitlement for a client who had sold his property to rent back. Ngaryan successfully argued that the client had valid reasons for having to sell the property to rent back, she was also able to secure discretionary housing payment to cover the shortfall of rent.
Ngaryan successfully challenged decisions on cohabitation and the issue of benefit fraud. She overturned an £80,000 overpayment and client remained entitled to benefit for the disputed period as we could prove that our client was not living with alleged partner.
Successfully advised and assisted a client in respect of entitlement to Disability Living Allowance (DLA) prior to turning 65 and not being able to claim this benefit. Secured arrears of Pension Credit and arrears of DLA.
