Professional negligence case studies

Claim for legal costs

The team represented a client who was given incorrect advice in settling financial matters following a divorce against a solicitor. Essentially the client was advised that her ex-husband would be entitled to far less than what he was asking for. The client wasted huge legal costs as a result of the advice from her solicitors and a successful claim for the wasted costs and expenditure was made on her behalf.

Claim against architects

The team represented a client who instructed an Architect to oversee and project manage a self build house. The Architect did not manage the project to a reasonable standard and failed to appreciate that certain terms of a JCT Contract were excluded in self build contracts. As a result of the failure to contract out some terms relating to adjudication, (amongst other things), the client had to incur considerable expense in following an adjudication when the builders and the client were in dispute. A claim was made against the Architects for professional negligence which was successfully resolved in mediation.

Claim against vet

The team also represented a client who bought a horse which had passed a five stage vetting examination. However it transpired after purchase that the said horse was not of satisfactory quality in that it had many problems and these should have been identified by the vet at the examination stage. Due to his failure to address these problems in his certificate, the client had a claim against him for negligence. A case was successfully brought against the vet for negligence and damages and costs were awarded in favour of the client.
